1. Introduction

These Terms of Service (“Terms”) govern the use of the web services and products provided by OneSmartSite.com operated by Qalistic LLC (company ID: 203940695, registered in Bulgaria) (“we,” “us,” or “our”). By accessing or using our website or services, you (“Client” or “User”) agree to these Terms in full. Please read them carefully before proceeding with an order or using any part of our system.

Our services are provided by a European company with more than 10 years of experience in developing custom web-based solutions, including online stores, corporate websites, and presentation platforms.

2. Scope of Services

OneSmartSite.com provides a complete web-based business platform that includes, but is not limited to:

• Custom website development using pre-selected premium HTML templates (licensed from Envato and TemplateMonster or other third party partner) integrated into our proprietary PHP & MySQL-based content management system (CMS).

• Hosting services provided through our trusted hosting partners.

• Optional integration of e-commerce tools, including Stripe payment processing, DHL Express shipping solutions, inventory tracking, and basic shipping modules.

• Optional OpenAI API integration for automated content creation and translation, including HTML-preserving multilingual support.

• User management, custom registration forms, newsletter functionality, and physical store integration via the website admin panel.

• Image processing features, including automatic color grading.

Each project is individually configured based on the selected template, chosen features, and client specifications.

3. Licensing and Ownership

All websites developed under the OneSmartSite.com system are custom-built and hosted on our managed infrastructure to ensure reliability and system integrity.

• The Client receives a lifetime license to use the completed website on our hosting platform.

• The source system, CMS, and integration framework remain the intellectual property of OneSmartSite.com and are not transferable or self-hostable.

• The included design templates remain subject to the original Envato or TemplateMonster license terms.

4. Payment Terms

Pricing is based on the selected design, chosen features, and optional services.
We offer the following standard payment options:

1. Full amount in advance – 20% discount.

2. 50% advance / 50% upon delivery.

3. Not available at the moment: 20% advance self-funded – 80% external financing (10% surcharge). Additional charges may apply from the financing institution.

4. Order Review Service – Optional professional review of your order for 5% of its value, which is fully deductible if you proceed with the final order.

Recurring fees apply only to hosting, domain management, and optional support services.

5. Pre-Defined Project Packs and Customization

Clients may begin their project by selecting from our pre-defined premium packs (Web Store, Corporate Website, or Presentation Website) or by manually configuring all features.
Applying a pre-defined pack resets previously made selections and automatically loads the relevant pages and settings. Clients can then customize and adjust the configuration before submitting the final order.

6. Hosting and Maintenance

• All websites are hosted on servers operated by our trusted European hosting partners.

• Hosting ensures optimal performance, reliability, and security.

• Clients may purchase additional email, domain, or support services under separate subscription plans.

• Direct access to hosting infrastructure or codebase is not provided for system integrity and licensing reasons.

7. External Integrations

Our system includes built-in integrations for external services such as Stripe and DHL Express.

• Stripe is used for payment processing. Clients who activate this integration agree to Stripe’s own Terms of Service and Privacy Policy.

• DHL Express is integrated for automated shipping management. Use of this integration is subject to DHL’s applicable service terms.

• OpenAI API is integrated for automated content generation and translation. Use of this feature is subject to OpenAI’s API policies and limitations.

We are not responsible for service interruptions or changes caused by third-party providers.

8. Client Responsibilities

Clients are responsible for:

• Providing accurate information during project setup and configuration.

• Ensuring that all content, images, and materials provided do not infringe on any copyright, trademark, or applicable law.

• Managing their website data and maintaining compliance with data protection regulations applicable to their region.

9. Support and Updates

We provide system-level support, updates, and maintenance to ensure continued reliability.
Support plans and update coverage depend on the selected service level. Extended or priority support may require a subscription.

10. Limitations of Liability

While we take all reasonable measures to ensure stability and reliability, OneSmartSite.com shall not be held liable for:

• Service interruptions caused by third-party providers, force majeure, or client-side errors.

• Data loss due to user misconfiguration or third-party interference.

• Indirect, incidental, or consequential damages resulting from the use or inability to use our services.

Total liability in any case shall not exceed the amount paid by the Client for the service in question.

11. Termination

OneSmartSite.com reserves the right to suspend or terminate access if:

• Payment obligations are not met.

• The system is used for unlawful purposes or violates applicable laws.

• There is any attempt to modify, replicate, or misuse the platform’s core structure.

Upon termination, data associated with the client’s account will be stored for a limited period and may be permanently deleted thereafter.

12. Privacy and Data Protection

All data provided by clients is processed in accordance with applicable European data protection standards (GDPR).
We only collect information necessary to provide and maintain the services.

13. Amendments

We may update these Terms from time to time to reflect operational, legal, or regulatory changes.
The latest version will always be published on OneSmartSite.com, and continued use of our services constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the European Union and the Republic of Bulgaria, where our operations are based.
Any disputes shall be resolved by the competent courts in Bulgaria.
